Constitutional Rights and Guarantee of the Access to the Space
Every human activity requires space. Constitutional rights - freedom of speech, freedom of assembly, freedom of movement, etc. - are no exception. Public spaces controlled by the state, including public streets, parks, public squares, have served these freedoms where individuals cannot always have access to the space for exercising these freedoms. Recently, however, environmental changes surrounding public space have posed negative effects on the realization of these freedoms. The main reasons for this are privatization and the widespread surveillance of public space. These phenomena, on the one hand, reduce the possibility of exercising freedom by delegating the property to private individuals in order to evade constitutional constraints, and on the other hand, individuals who fear surveillance by public space may refrain from exercising their freedom, posing the danger that the constitutional guarantee would be empty. Through the overview of my past research and future research projects, we would like to show how constitutional law can contribute to taking back public space with free and equal access.
