Summary
Cross-border digital trade (CBDT) has been a key driver of global economic growth. Harmonization—making the laws the same or similar in different countries—is important to expand the CBDT market globally. Thus, most trade agreements require their member to harmonize their competition laws. However, they rarely specify the level of harmonization, which may pose enforcement difficulties. This project aims to fill this gap by employing both economic analyses of law and comparative studies to explore what level of competition law harmonization should exist to promote CBDT in Asia. The findings will be presented to the authorities for harmonizing competition laws in Asia.
